By accessing or using our platform ("the Platform"), you automatically agree to the following Terms and Conditions. If you do not agree, you must stop using the Platform immediately. These Terms apply internationally, regardless of your country of residence.

1. User Accounts

You must provide complete and accurate information when creating an account and keep your login credentials secure. You are solely responsible for all actions taken under your account. We reserve the right to suspend or terminate any account suspected of fraudulent, abusive, or unlawful activity.

2. Users Under 18

Students under 18 may use the Platform only with the full consent, supervision, and responsibility of a parent or legal guardian ("Guardian"). Because minors cannot open a Whish Money account, all payments, credits, and financial transactions must be processed exclusively through the Guardian’s Whish Money account. By linking a Guardian’s payment account to a student profile and completing any financial transaction—such as adding credit, purchasing a session, or paying a fee—the Guardian explicitly consents, accepts full responsibility, and agrees to all Terms on behalf of the minor.

3. Payment Terms

All tutoring payments must be processed exclusively through the Platform. Currently, the only accepted payment method is Whish Money. Platform fees are non-refundable.

4. Refunds & Cancellation Policy

Student Cancellations

• >24 Hours: 100% refund, one reschedule allowed
• 12–24 hours: 50% refund, one reschedule allowed
• 6–12 hours: 25% refund, reschedule not guaranteed
• <6 hours: no refund, no reschedule

Tutor Cancellations

Student receives full refund. Repeated cancellations may lead to tutor suspension.

No-Shows

• Student no-show: tutor paid in full
• Tutor no-show: student refunded, tutor penalized

5. Rescheduling Policy

Rescheduling follows the same timelines above.

6. Tutor Responsibilities

Tutors must provide accurate profiles, deliver professional sessions, comply with laws, and avoid misconduct.

7. Student Responsibilities

Students must attend on time, behave respectfully, and provide honest feedback.

8. Copyright & Intellectual Property

All content is copyrighted. Tutors retain copyright unless explicitly transferred. Students get personal use license only. Unauthorized use may lead to legal action.

9. Recording Policy & Data Retention

The Platform does not store recordings. Temporary access may be requested for disputes and deleted immediately after resolution.

10. Refund Requests

Submit within 6 hours; processed within 48 hours if valid.

11. Prohibited Use

No illegal activity, harassment, fraud, hacking, impersonation, or cheating.

12. Indemnification

Users indemnify the Platform from claims arising from use, violations, disputes, or misuse.

13. Governing Law & Arbitration

All disputes arising from or related to the Platform, including payments, sessions, cancellations, or user conduct, shall be resolved exclusively through binding arbitration administered by the Dubai International Arbitration Centre (DIAC). The governing law for this contract shall be the laws of England and Wales. By using the Platform, users waive any right to initiate or participate in class action lawsuits or group claims. Arbitration awards issued by DIAC are final and enforceable internationally under the New York Convention.

14. International Application

Terms override conflicting local rules. Users responsible for local law compliance.

15. Termination

Accounts may be suspended or terminated for breaches, fraud, unsafe conduct, or misuse. No refund upon termination.

16. Marketplace Intermediary Disclaimer

Darresne.me operates solely as a marketplace and intermediary connecting students with independent tutors. Tutors are not employees, representatives, or agents of the Platform. They operate as independent service providers and are fully responsible for the accuracy of their profiles, the quality of their sessions, compliance with legal requirements, and all interactions with students. The Platform does not supervise, control, or guarantee tutor performance, academic outcomes, or session content. The Platform has no liability for disputes arising between students and tutors.
